KEENE, N.H. (MyKeeneNow) A Keene resident who was wounded by a police officer during an armed confrontation last spring has been sentenced in Cheshire County Superior Court, ending a case that drew months of scrutiny from state investigators.
Cullen Costa, 25, admitted responsibility Tuesday to a single count of reckless conduct with a deadly weapon. Prosecutors agreed to dismiss two additional felony charges originally filed after the April 29 encounter.
Judge Anne M. Edwards handed a sentence of 3½ to 7 years at the New Hampshire State Prison, though the entire term was suspended for four years as long as he complies with all conditions. Costa will be supervised on probation during that same four-year period and is barred from possessing firearms.
Court records outline the sequence of events that led to the confrontation. Costa had dialed 911 that afternoon to report what he believed was a suspicious person near Baker and Colby streets. When officers arrived, they encountered Costa holding a handgun. According to an affidavit filed with the court by a state police detective, officers repeatedly urged him to put the weapon down. Instead, Costa raised the gun toward Keene Police Officer Jake Dube, the affidavit said.
A single shot fired by Dube struck Costa in the chest. The New Hampshire Attorney General’s Office investigated the use of force and concluded in November that Dube acted lawfully. Investigators also determined the weapon Costa pointed at police was a privately made, unserialized firearm.
Costa spent several weeks in custody at the Cheshire County jail after his release from the hospital. He was later allowed to live under electronic monitoring.
Costa’s father was former Keene Police Chief Brian Costa, who died in 2017.
